Can the tenant continue staying after the expiry of the agreement ?

Please advise as my tenant is continuing to stay though the rental agreement expired in November 2016. Even after various attempts to meet him to renew the agreement, he reverted back only by the end of December stating that he is vacating, with two months notice period from Jan to Feb. Would like to know ~1- can the tenant continue to stay post expiry of rental agreement up to Feb 2017 (notice period from Jan to Feb) ~2- Can I request for increase in rent for these three months though there is no new agreement in place

A tenant is ceased to continue after the expiry of the rent agreement without there being any oral or written conswnt from the landlord to that extent. If the tenant continues to be in possession of your premises then the same is considered to be illegal. You can claim highet rent but the fact tbat claiming or admitting rent from.agreement amounts to implied approval of the tenancy.

If tenant already given notice stating to vecaute the then you have to give time for him at a fortnight tenant you cannot evict tenant as the tenant is in possession of House his rights will be protected by Court also
On understanding you can ask for enhancement for rent
Better to provide notice period time and get evicted from premises

sir, I can suggest you to continue him and you can also enhance the rent as per the terms and conditions. It also amount to oral concent for continue his tenancy. If he will not pay the enhance rent you can demand by noitce.
