After rent agreement came into effect other party backing out. Remedy?

I signed an agreement with a tenant to give one BHK flat on rent. The agreement is effective with today. We gave everything for police verification and to the society, the tenant has given security and one month advance cheques. Now tenant is asking he is not interested but there was a locking period of 6 months. Now he is telling not to put the cheque. What action can i take against him?

Deposit the cheques. If they bounce then you may file a cheque bounce case and recover two months rent at the very least. You could look for another tenant in the meantime. If you are still not satisfied you could file a suit for specific performance of the contract.

However, you will end up incurring more expenses in doing so. Cheque bounce proceedings on the other hand can be done away with at a comparatively faster speed and lower cost. You will have to evaluate if it makes sense for you to file a civil suit.
