Working in state PSU employer not providing NOC for interview

15-Nov-2023 (In Labour & Service Law)
Sir, I am currently working in a state owned PSU and have got to attend an interview in a central PSU. but my current employer is reluctant in issuing NOC as I am in probation while it is a ground rule to produce NOC for attending the interview. I have been working with my current employer for the past 4 months only. What will happen if I hide my current employer details and attend the interview and resign directly from the current job if selected. The psu where I have to attend the interview says that if they find out at any point that i was associated with a state psu which I hid, I shall be terminated straight away. Pls help

Technically that is right. any non-disclosure of previous employment can render you disqualified. You can file a writ application in the High Court for directing the STate PSU to issue the NOC. Urgent steps can always be taken.

Hello,
Having gone through your query I would like to inform you that there is no specified law of rejecting the NOC or either any rule prevalent in that effect you are entitled to leave one job and take up another following the due procedures/rules set by the department where you are working
So first and foremost you write a representation letter to the department and demand a written rejection letter if they reject your claim the same letter will be then challenged in the High Court under 226 on the ground of protection of Fundamental Right.
