UPSC service appointment while having an FIR

If a fir was filed on a person,later the police filed the final report stating that case as false case.then will the person eligible for appointment of service under upsc.

Yes. Mere registration of an FIR does not automatically disqualify a person from appointment through UPSC, particularly where the police have filed a final report/closure report stating that the case is false. However, appointment is subject to verification of character and antecedents and the applicable UPSC/service rules. Any question in the attestation form regarding FIRs, criminal cases or arrests must be answered truthfully. Suppression of such information can itself lead to cancellation of candidature or termination. The Supreme Court in Avtar Singh v. Union of India, (2016) 8 SCC 471, laid down the relevant principles.

hi yes he could apply for the exams and that there would be no bar and if the Respondents are not allowing to write exams then you could approach the court for seeking relief from the Court and that then you could obtain relief

Yes. The appointing authority should take the final police report and the complete circumstances into consideration. If the FIR was found to be false and the final report was accepted by the competent Magistrate, the mere fact that an FIR was once registered should not, by itself, disqualify the candidate.
