As you are telling that his father was working as a peon in a government bank, after his death, he got a job as a peon and that too by producing a fake certificate of eighth class. There is a provision of punishment for forgery under section 465 of the Indian Penal Code. Under this section, if you commit any kind of fraud, you can be sentenced to a jail term of up to two years or you can be fined, or you can have to face both jail sentence and fine. . The person may be charged for forgery, conspiracy etc along with recovery of the salary he received for the time he served on the basis of forged documents.
But there are precedents where such persons are discharged from the criminal liabilities and only recovery has been made.
