Resignation Due to Salary Hold and Subsequent Salary Deduction

25-Jun-2025 (In Labour & Service Law)
Is it lawful for an employer to withhold salary and then deduct additional amounts during resignation by claiming the notice period was not served, even though the resignation letter clearly stated that the reason for leaving was non-payment of salary? What actions to take?

If you have not served the notice period and there is a term in your appointment letter for such a deduction only then can the employer do so. Feel free to contact me for seeking any legal advice as regards the same.

Well, an Employer cannot withhold your Salary and deduct additional amounts during Resignation by claiming, that, the notice period was not served! Notice Period was not served because the Employer himself was not paying the Salary!
