04-Apr-2024 (In Labour & Service Law)
I have received notice about violating the non compete clause and asked to resign from the current company within 5 days and informed to send the resignation details in response to the notice failing which they have mentioned that will take legal action on us both civil and criminal. What can i do on this.

Hi, If your present employer has sent you notice stating that you have violated the non-compete clause of the your appointment letter and they are directing you to resignation on that basis then you need to go in the deep and see whether really you have violated the terms and conditions and if it is not then you can give the response to their legal notice stating that your defence that you are have not done . this is clearly a civil they can't implicate you in any criminal case if it is then you can take the help of any legal representative further we can suggest after verification of the documents on what basis they are alleging you
