NIC Scientist-B OBC-NCL Certificate Dispute

I am seeking urgent legal advice regarding my NIC Scientist-B Recruitment 2026 case. My interview/document verification is only about 15 days away. I have never changed my name. My FY 2025-26 OBC-NCL certificate mentions my name only as “Yash”, while my subsequent corrected OBC-NCL certificate dated 21/04/2026 mentions my full name “Yash Rathore”. My concern is that NIC may reject my OBC-NCL reservation benefit because the FY 2025-26 certificate does not contain my surname. I want to know the quickest and legally strongest way to establish that “Yash” and “Yash Rathore” are the same person, considering the very limited time available. What documents or legal steps would you recommend in this situation? Would a notarised affidavit or other declaration/documentary evidence be sufficient? Should I immediately submit a legal representation to NIC/MeitY, or is there any other urgent remedy I should pursue before the interview?

There have been very recent cases addressed by courts wherein the issue of defective surname was under question. The courts have consistently held that any error/omission in the caste certificate not being a fault of the candidate should not be a ground for rejection of his candidature in employment. now there is very limited time left for any rectification to be considered by the issuing authority however you may approach them for any clarification in the certificate. should you have any queries please feel free to contact me.

Yes. First submit an urgent representation to NIC/MeitY with the corrected OBC-NCL certificate, identity documents and a notarised affidavit establishing that “Yash” and “Yash Rathore” are the same person. If NIC refuses or threatens rejection, promptly approach the jurisdictional High Court under Article 226 seeking appropriate directions before document verification.

A notarised affidavit by itself may not guarantee acceptance; however, when supported by consistent government records and the corrected OBC-NCL certificate, your case becomes substantially stronger. Since only about 15 days remain, do not wait until document verification. File the representation immediately and obtain an acknowledgement/email proof of submission. If NIC nevertheless rejects the OBC-NCL benefit despite the documentary proof, an appropriate legal remedy, including approaching the High Court under Article 226, may be considered depending on the recruitment rules and the reason for rejection.
