Legal notice received from ex-employer for not serving notice period

I receive leagal notice from my last employer because i did not served notice period, and he is blaming me that i steal their data and share it with my current company, so plz suggest what should i do

Hi,

Its a serious issue. I was defending a client who was put in jail by other party. But he had proof that he had stolen the company data.

Steps you can take-

1. If you have actually stolen data- then try remembering how company came to know about it. Do they have any computer monitoring software? The accordingly prepare a reply to notice after consulting with lawyer

2. If you have not stolen data- Even then prepare the reply to legal notice, as these issues should not be ignored. Not serving notice period is not an offence but stealing data is a criminal offence.

Your employer can, at best, sue you for not serving your notice period. However, blaming you for stealing data is devoid of any merit, and hence you can fight him on this. Regarding what can be done, show me the email/legal notice you have received by which they're blaming you.

hi , you have to reply the legal notice within prescribed period , other wise you will have to face problem. rest dont worry, he cannot do anything legal remedies are available for you also . you can take appointment alongiwth all documents . thnx
