Is it mandatory for every organization to implement new maternity law

Dear Sir/Madam, This is to inquire about the implementation of maternity law (leave for 6 months) in private sector. I work in a private university and now from august onwards I want to go for maternity leave but my organization says that they will give me only 12 weeks leave which is there in their policy. They have not updated their policy so I just want to ask you if it is mandatory for every organization to implement this new act (26 weeks leave) in their policy? If yes, then I will take further actions against them

Yes they have to implement the new policy and if they are denying about implementation of the policy you can take legal action against the employer. Further you have statutory right to have maternity leave as presecrieb understand rthe act. The policy is applicable irrespective of the fact of nature of employer i.e, private or public.

The provisions of the Maternity Benefit (Amendments) Act 2017, whereby the maternity leave increased 12 days to 26 days , are effective from April,1, 2017, The Act applicable to both private sector and Government Sector. 26 days will be with full paid wages/salary. action can be taken against the employer if denied to give maternity benefits .
