Franchisor not signing agreement and supplying machianery

I have paid money to a franchisor for setting up business under his brand. He hasnt sent me the agreement till date nor supplied macihianery. He is not answering my call and blocked by number. Planning to File an FIR. Need advise on how to file an FIR and under what section. If you can help me with a draft it would be great.
hi first need to see whether any agreement was entered upon by the parties and if he is noy performing his obligations then you could aend him legal notice for specific performance and you could also file civil suot for repayment of advamce amount
