Employer fraud in PF/EPS bifurcation; claim rejected; need to sue for

My ex-employer didn't bifurcate my EPS (pension) for 2.3 years. EPFO confirmed in writing it's the company's fault. Now, my PF claims are rejected, EMIs bounced, and CIBIL is ruined. The company falsely claims I chose "Zero Pension" (legally impossible) and is now ignoring my emails. This is a mass issue affecting many. I want to send a legal notice for rectification and compensation for financial loss & mental agony. Please advise on Labour Court/Consumer Forum.

hello, you can send a legal notice to the Company. if they do not rectify and compensate the financial loss, you can file a complaint with Labour Commissioner and then approach the Labour court consumer forum is not the proper forum

As a widow, you and your daughters can claim maintenance from your father-in-law if he has sufficient means, under Sec 19 of Hindu Adoptions & Maintenance Act. You may also seek residence and protection under DV Act if harassed.

Issue legal notice seeking rectification and damages. File complaint before EPFO/RPFC and approach Labour Court for service dispute. Consumer Forum may not apply. Claim compensation for loss and harassment.
