Contract extended on last working day but now school denying the same

02-Mar-2023 (In Labour & Service Law)
I was employed with a private school on contract basis. I left the school after the contract expired. I signed another contract with school on the last working day, but now they are denying the signing of any such contract. I tried it through RTI as well. They have not paid my salary for the last month and did not pay for security deposit as well. I complained to the Directorate of education. What action can i take against the school. I saw the extended contract myself but have no copy of it.

Clearly you could contemplate approaching Court for appropriate relief. The only difficulty is proving existence of 'extended' contract. If there are other teachers like yourself who have gone through such ordeal, your case would be stronger.

is any action taken on the complaint made to the Directorate of Education? if you dont have the copy of the contract, it will be difficult to get the same enforced. you have to file suit for enforcement of the contract and as well as recovery of the amount.. and in that you have to pay court fees..

another option is you can file a writ petition making the Directorate of Education as the first party as the writ against the private party is not maintainable...

If You don't have copy of new contract then it will be very difficult to establish its validity however you can file recovery of money suit in the court of competent jurisdiction for recovery of salary and deposit.
