Child Care Leave Regulation For PSUs

I am employed in AI Engineering Services Ltd. (kolkata)(erstwhile Air India Engineering Services Ltd.) as a Asst Engineer (Fixed Term Employment) which is a PSU. I have taken Maternity Leave from 23 Oct 2021 to 22 April 2022, after that I have to further extend my leave because my child at that time was only 5 months old and required my attention. Meanwhile my husband (IRSS 2016 batch) who is currently posted in Malda WB, had already applied for transfer to Kolkata but due to some administrative problems his transfer has been put on hold. I have exhausted all my leaves and currently on Leave Without Pay. I have got 2 show cause notice to give proper reason and to join immediately which is still not possible given my child is only 1 year old and need my attention and we are not able to get any extra help from family at this point or I will get terminated. nGiven my current situation I want to know about the child care leave regulations specifically for PSU and how I can avail it?

Irrespective of any organisation, the Maternity Benefit Act applicable in all organizations. However in Government undertaking may be you have more benefits. You can file an RTI to know the specific rules regarding the Maternity Benefit Act. However you are entitled to enjoy maternity leave for a period of 26 weeks under the Maternity Benefit Act.

if all leave facilities are already exhausted and still you are in need of leave then you can approch the authority concerned with a fresh application stating your facts in details, before that you must reply the showcause notices. If after that also your authority rejects your prayer then you can approch the appropreate Court/Tribunal challenging the rejection order.
Your husband also can approch appropreate court/tribunal for grant of his transfer showing the reasons.
