Can I request company to cancel the issued experience letter
11-Jun-2026 (In Labour & Service Law)
I joined the IT MNC on 26 Nov 2020, resigned on 23 Dec 2020, and was relieved on 26 Dec 2020. No relieving letter was issued. An experience letter was later emailed on 06 Feb 2021.
No salary was paid by any means, no payroll was processed, no PF/UAN records were created, and no Form 16 was issued. Incorrect Form 26as entries were later successfully reconciled by the MNC following an Income Tax Portal grievance. Now the updated form 26as reflects ₹0 salary, ₹0 tax deducted and ₹0 TDS
Based on the facts stated, if no salary was ever paid, no payroll processed, no PF/UAN generated, no Form 16 issued, and the employer has already corrected Form 26AS showing ₹0 salary/₹0 TDS, it indicates that no employer-employee financial relationship was actually executed beyond formal joining. Since you have an experience letter and relieving date recorded, the company has acknowledged brief employment but cannot legally claim salary/payment obligations that never arose. Preserve all email records, resignation acceptance, experience letter, and corrected tax records. If any future background verification or employment dispute arises, these documents will sufficiently establish the actual status and protect your position. If any incorrect employment record still exists elsewhere, a formal legal notice can also be issued for correction.
