Can an employee file case against wrongfull termination on company

I am a executive in corporate industry. My wife commite suicide and from her family side registered a false case against me. I was in jail custody for approx. 4 months.. My company give me notice for join immediately but i am unable to join and from my family side give proper response which mention all. Same time Lawyers association also on strike so my bail application got delayed. Company terminate me due to long absenteeism. Due to this case my financial condition gone down so i withdraw all amount from my company. Can i file case against company for my termination because in this case i am unable to join company and i make no loss to company.What shall I do?

My dear friend, on account of absent company can give a notice to his employee, but without giving proper opportunity of hearing as per law company cannot terminate. You have right to appeal or file a case against the order.

Was there any written contract between you and your company.....Or tha appointment was an oral contract....You may file a civil suit against the company.....And Courtnay declare the termination as voice....But all the statement you mentioned will have to be proved...

i can understand you feeling.
please go through your offer letter, there will be all terms and condition of employment which will help you to understand.
there is certain remedy for wrongfull termination but depend on case and condition of employment agreement.
