How to get custody of child if UK court has given it to father already

I am in Dharwad in Karnataka. I was married to an NRI 13 years back only to find that he was already married and the marriage was still subsisting. I got married to him in Dharwad. When I was with him in UK I delivered a boy child. When I came to know of his first marriage, I returned to India along with my baby. He has moved the court in UK. Now my son is 10 year old. He has got a decree from a court in UK to have custody of my son. Please advise me. I need a barrister who can help me. I have worked hard and have brought up my son. I do not wish to part with him.

You have to immediately move the court at your residence and place the facts before the court seeking to not to consider the decree of UK court and also to continue to have the custody of your son.



The court will definitely not execute the decree of UK court and will pass an order favouring you to continue to have the custody of the child since you have groomed him up. But, the court may further order favouring your husband for his visitation rights which you cannot avoid.
