How to defend a case of sexual harassment at workplace ?

22-Nov-2023 (In International Law Law)
I am a I T executive, married, serving a company at Bangalore. Recently the company had sent few of us to Philippines for advanced training. We were provided with separate accommodations in a hotel. In a weekend, I along with some of my friends chilled out in a bar. After this we brought liquor to my room and chilled out. A colleague of mine, lady, was also with us. When everybody left my room, I asked her to go to her room. She said it is ok and requested to sleep in my room. She slept on my bed wrapping herself with a separate blanket. I allowed her and in the midnight, she left my room and complained against me on sexual harassment. Honestly no such move I have made. Now, my company at Bangalore, called me back to Bangalore and has sent a notice to me for explanation. I do not know what to do. She is still there at Philippines. Please advise how to go about for my defense.

From your available inputs, I can say that you please reply to the notice of what really happened. Here, you may need the assistance of an Advocate well versed with the Law on the subject of sexual harassment at workplace and also good in International Law. This is because, the cause of action has araised at Philippines.

There are many factors involved here including the status of mind of both of you. She was certainly in an inebriated condition at that time. Since she herself has requested you to allow her to sleep in your room, that too sharing your bed, there is additional protection you can take as defense on this ground.

However, I suggest you certainly need the help of an Advocate who has experience in crime matters which is alleged to have taken place outside India, but, enquiry proceedings initiated in India. We can professionally assist you in this regard.
