How can a Bangladeshi exporter recover dues from Indian customer?

23-Nov-2023 (In International Law Law)
We are from Bangladesh. We have exported electronic goods to a customer in India. We have exported based on irrevocable LC. The value is US $ 340000. After several follow-ups and after a broken arbitration we moved the court at Dhaka and got decrees against the consignee and its banker. The copies of decrees have been served by courier to the parties. Still, there is no response. How shall we go about to receive our payment?

You have not clearly spelt out the matter, may be on confidential grounds. Keeping whatever you have expressed these are our views:

Firstly, You cannot serve a decree on parties located in another country like the way you do within your own country. There is a procedure prescribed in International Law which you need to follow.

The decrees you have obtained from the court at Dhaka have to be executed against the two parties, in turn, by the appropriate jurisdictional court in India. To do this, we need to peruse the required documents, petitions you have moved, court order copies…

We practice in International Law. You may contact us for further discussions, should you need our professional assistance.
