What to do when insurance company insists on repairing car?

06-Oct-2023 (In Insurance Law)
I purchased a car, Hyundai i20 on last December 2016. My car was flooded in in flood 21 August 2007 at Mohali. Car is insured by Bharti AXA. We have taken the car to the service center. Initially service station said that car cannot be repaired and it should be considered as total lost. But insurance company didn't agree on that and asked service center to repair the car. Now it's been around 2 month service center is not able to repair the car. once I ask how much time it will take more, service center just say that we require some parts which is not yet delivered. They even not able to give the time when the part will arrive and car will be repaired and delivered to me. I am running in uncertainty that when I'll be getting back my car. I just want to know that what legal action can I take against the Insurance company or Hyundai service center. Can I force insurance company to consider it as full lost as car was fully flooded and Hyundai is still not able to repair as it require

You can send bharti axa legal notice for the concern. You can also file consumer plaint in respected redressal system. Further more you can ask for alternate car. You can force to the extent by sending them legal notice and file consumer case against the insurance company.
