Physical damage claim due to hit by bike

While crossing the road ,I am hit by a bike rider driving rashly leading to my back bone fractured.
Fir is done.I am on bed since 15 days .how can I claim compensation for the monetary loss and future physical issues loss also need to legal punishment the culprit.pls.suggest .how much claim can I get .I have claimed the medical expense 90percent through my mediclaim policy.
Well, you can file a Civil Suit to seek Exemplary Compensation of atleast 10 lakhs as your backbone has suffered a lot due to fracture which would have resulted in loss of business opportunities or job.
