Insurance claim for accident vehicle

08-Mar-2025 (In Insurance Law)
I met with an accident and my car got damaged with damaging any others property . My vehicle is registered with Delhi RTO , now it is being transfer to Odisha for address change in RC copy , but it is under process , I have taken NOC from Delhi RTO in 29th Sept 2024. But Insurance service provider ( Bajaj Allianz ) has denied for the insurance registration and payout . reason - tax is not paid in Odisha .

Bajaj Allianz's denial of your claim due to unpaid Odisha road tax is not legally tenable. Insurance policy validity is not related to non-payment of tax. Insurance policy is a contract between you and Bajaj Allianz to cover your risks against payment of insurance premium. Whereas, road tax is imposed by a statutory authority. Insurance payout is subject to breach of terms and policies of your insurance policy, and not upon non-payment of tax. Bajaj Allianz is definitely at fault for denying your claims. you have a case on merit. Your insurance policy remains valid despite the NOC issuance and ongoing re-registration. Road tax and insurance are separate; non-payment of tax does not impact claim eligibility. The denial is unfair unless a specific policy clause supports it. You can challenge this by filing a complaint, escalating to the Insurance Ombudsman, or approaching Consumer Court if needed.
