24-Feb-2025 (In Insurance Law)
i have filed a complaint of ethecis in Maharashtra Medical Council, complaint is for side effect i got from taking prescribed medication. Side effect is presistant after 6 months. The M'council says i will have to appear in some time to show my illness but they do not provide compensatjon for medical neglect. Thet said i have to go to consumer comission. Will i need a lawyer in medical council hearing and consumer comission? Kindly note im handicapped.
The Maharashtra Medical Council (MMC) itself does not pay compensation for medical negligence. However, it can take disciplinary action against doctors found guilty of negligence, including removal of their registration.
If you're seeking compensation for medical negligence, you can file a complaint with the Consumer Disputes Redressal Forum or the National Consumer Disputes Redressal Commission. These bodies can order compensation to be paid by the doctor or hospital found guilty of negligence.
In Maharashtra, you can also approach the Maharashtra State Consumer Disputes Redressal Commission for compensation. Additionally, the MMC can also provide guidance and support in filing complaints and seeking compensation.
It's essential to note that compensation for medical negligence is awarded based on the severity of the negligence and the resulting harm or injury. The court or consumer forum will assess the case and determine the amount of compensation to be awarded.
