Delayed claim settlement by Insurance Company

My business premises caught fire & everything was destroyed. Insurance company took more than a year to settle the claim, which has resulted in further interest losses. Can i file a case against insurance company in consumer court ?

Yes absolutely. You can file a claim both at the consumer court or at the civil court. This shall ensure that the insurance company actually goes ahead and approves or repudiates your claim as soon as possible.

You can surely file a case against the insurance company claiming interest for delayed payments. However the same will not survive if the insurance company is able to show why the delay in payment was caused. Filing a case against the insurance company might however strong arm them into paying you some of the interest amount as a settlement and the court may also direct the parties to come to a settlement and the same will be beneficial for you. Insurance companies act in a very clandestine manner when it comes to payment of claims. You need to fight for your lawfully recoverable debts.
