fraud Committed By Real Estate Agency For Confirm Allotment

I paid 1.5 lac to real estate agency in gurugram under affordable housing project in sector 92 in gurugram for 3 bhk confirm allotment in my mother's name. Since the project is now converted to luxury not being launched under affordable scheme. I asked for refund of the said amount to real estate agency. But they are not willing to refund the money. I also sent legal notice to them but no revert received from them. Now I want to file case for fraud committed by them as no confirm allotment thing exists for which they charged me 1.5 lacs. Also to recover my money with interest and penalties. Also would be looking for maximum imprisonment of those who committed fraud.
