windowed Daughter in law not leaving house

18-Aug-2023 (In Family Law)
My son has passed away and I am the sole owner of a self acquired property. My widowed daughter in law refuses to leave the premises. What can I do ? Can you tell me both civil and a criminal suit way to evict her.

I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise. There are judgments wherein it was held that daughter in law does not have any right in the self acquired property of the in laws.

according to law you have a right to suit for evictions. and if she has a kid to ur son thn he/ she has a right in his/her father's means ur son property not in your owned property. ur daughter in law has no right in ur property

If you are a senior citizen that means if you are above 60 years of age, then you can file an application at the maintainance tribunal whereby you will be seeking eviction of the daughter in law on the grounds of non maintainability and ill behaviour with you. This will make sure that she is not able to file any case against you and you will be getting the property vacated.
