Wife's parents come and leave with her and child and all jewellery

29-Aug-2023 (In Family Law)
On 23 AUG 2016 6:30 PM I saw all jewellery and my college degree is missing. I asked wife, she lied its with my Bua. Then I asked her again, she not say anything. After 30 mins her phone rings and she had called police. Then she shouted from balcony and called building guards. Police came - she did not tell. Her parents came at 9 PM. Immediately she gave jewellery already packed in bag to her mother. They were angry and left with child and jewellery. Later I saw her phone, it had divorce matrimony open. Child is 2 yrs 9 months. She was living with me for 3 yrs before marriage.

Hi,
If she wants divorce then file divorce petition its a best option and seek for the custody of your child in interim under HMA and file separate application for the custody of child under guardian ship and wards act 1890.

Thanks

You have not asked a question and so it is not possible to guide you properly but in this situation you first need to find out what all has happened and what complaint if any has been given to the police. You must find out what your wife wants and try and settle the matter among yourselves without the involvement of police authorities. If need be you may have to also file an FIR against your wife.

You have not given any background information. I am sure it cannot be an isolated incident, things must have been building up earlier. How long have you been married, how has been the conduct of wife during you stay together, whether any reports have been lodged earlier from either side are some of the important questions to be answered. Please provide details to get the right advice.
