Wife sending lakhs of rupees without my knowledge and consent

03-Oct-2023 (In Family Law)
Wife sending lakhs of rupees without my knowledge and consent. I have asked her not to do that, as they have decent income (2023 tax refund of 12 lacs), and have an earning son to take care of them. She is still hiding and lies to me. Just last month she sent 2 lacs and when i found out, and confronted. I guess around 20+ lac is sent to them in past 5 years without my knowledge, and need access to her bank account to prove it. Can I file for divorce as financial fraud in this case ?

It’s not financial fraud as you have sent the amount to her account n then she transferred the amount from her account. This can be covered under cruelty and you are entitled to recover this amount from your wife if you have given it for yourself ! Plz b in touch to discuss this!

Yes...that's a valid ground for divorce and comes under section 13(1)(ia). And if there's no scope of living together then rather stretching the relationship you should file for a contested divorce. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.

Yes, you may file a divorce case on the ground of financial cruelty in family court of your territorial jurisdiction. It is advisable to gather all evidence before filing a case and try not to reveal your intentions of filing your case against her as she might get tike to prepare a defence in her favour and she might implicate you in false cases herself. Lie and concealment of facts by your wife amounts to mental cruelty. You can file for divorce and can also seek the recovery as the said transaction has taken place without your knowledge and the funds belongs to you. For any further clarification feel free to contact. Thanks
