18-Feb-2026 (In Family Law)
19days back one small argument started. My wife continuously scolding to my youngest daughter while she is going to school. I heard I scold her regarding that matter. She reversed on me and scolding me without respect. I hit on the hand.she cancel the school and left with the Childrens. On 14th I visited her mother home to get back to my home, but her mother is not ready to send with me. So, returns back. Her mother and their sisters are doing our family disputes.

Hello Sir, From what you have stated, this is a family dispute and your wife has gone to her mother’s house with the children after an argument. Please note: If you hit her, even lightly, she may file a complaint under the Domestic Violence Act or 498A IPC. So avoid any further arguments or physical confrontation. If she is refusing to return without valid reason, you can file a petition for Restitution of Conjugal Rights under Section 9 of the Hindu Marriage Act. If she is not allowing you to meet the children, you can file a custody or visitation petition in the Family Court. The Family Court usually sends such matters for mediation first, to try for settlement. Decide whether you want reconciliation or separation, and then take the legal step accordingly. as per law you can file a conjugal rights if she is not comming to your home...but it can be solved amicably with elders as this is a small argument issue....go to one of your relative which is mutually very cooperative in solving this issue....

If your wife has left the matrimonial home along with the children after the incident, the immediate focus should be on reconciliation and lawful resolution rather than escalation. You may consider the following steps: Attempt Mediation: Try resolving the dispute through elders, family mediation, or professional counselling. Family disputes should ideally be settled amicably, especially when children are involved. Counselling: You may suggest marital counselling through a recognized counselling centre or family welfare committee. Legal Notice for Restitution of Conjugal Rights (if needed): If she refuses to return without reasonable cause, you may consider filing a petition for Restitution of Conjugal Rights before the Family Court.

hi, you can file a petition for Restitution of Conjugal Rights under section 9 of Hindu Marriage Act in the family court to seek to restore your marital relationship lawfully and also request visitation for your children.
