Wife Extra Maritial Affair Revealed After Marriage 1 Year

04-Jun-2023 (In Family Law)
Hi, I got married on 28 Feb,2019. I came to know that my wife was having an affair with a guy in the tenure (Sep2019- Dec-2019), I have some pics of my wife wherein she can be seen lying with the guy with clothes on, kissing him and some Chat logs. After marriage 1.3 years, i discovered she is still making calls to that guy secretly. i have call logs for same. If she & her family is apologizing our family and saying that it won't be repeated in near future, on what legal backgrounds should i allow her to start living with me. Means is there any bondpaper or plain paper wherein acceptance of her mistake by her and her family would serve as a proof in near future if she commit such a mistake again. Am i also supposed to be disowned by parents property to secure them. And some more relevant advice

Dear querist, It all depends on what you are planning to do with your relationship with your spouse. 1. If you want to end the relationship then you have option to file a divorce in a ground of adultery and cruelty, which will ultimately end your bond with your spouse. 2. If you are willing to continue with your relationship and want to make sure that nothing of such sort should happen again, then you have to get a declaration deed or an affidavit(non-judicial) of an agreement between you and your spouse for the same. Which in further case, if again it happens then you can take effective actions against her.

Hello I have perused your query. In these circumstances you can settle the matter through a deed or MOU which can be registered before the court. You can list all the clauses in that MOU of your choice by which you seek to accept her back in your life, this can also be done mutually.. For further information feel free to reach out to us
