Wife don't want divorce and but want to keep the child what to do

10-Jul-2023 (In Family Law)
My husband and I are married for 6.5 years and have a 15 month old baby. A month back I left my husband's home (where he lives with his parents) because there are some very serious issues going on between us. Now, I am living separately along with my baby and do not want to go back. I am a well earning mother well capable of taking care of my baby and do not need any kind of support from my husband. However, my husband and his family are pressurising me to send my baby to them for few days as they want to spend time with him too. I sent my baby for a day today with them and now they are saying they want to take him everyday. I am not ready to let my baby stay with them that often without me. I am not interested in divorce but if they pressurise to take my baby, I am ready to go that path to get the baby custody.

Hi, As per supreme court judgement a women is better capable to take care of her child needs than men. Need not worry about the custody. There are many legal solutions available with you. Feel free to have a word with me for more information. All the best

There is no need to give divorce and all. All we need to file petition for custody of child under guardian and wardship Act. We need to prove before the court that emotionally as well as economically we are self reliance to maintain the good growth of the child. In that case child will be staying with you permanently and on the another hand court will grant them visiting rights on monthly basis or whatever court feels fit.
