Who inherits the joint savings of childless couple ?

07-Jan-2023 (In Family Law)
we are a childless doctor couple and my husband is a Christian and I am a hindu converted to christian for the marriage. We have joint savings in which my husband has kept his father's name as nominee in all our savings in case of our death together. my husband told me that since i am married to him, all the property should go to his family after our death and not to my legal heirs and refuses to allow me to have a separate savings in my name. I was told that i don't have the right to i start a separate saving or object to my father in law being nominee for our joint account. I have willfully at my own wish signed an agreement before marriage that i will not be eligible for my father in laws property in case the marriage separates, but now is confused that my father in law has all the rights over my savings after our death. Making a will is out of question. plz inform who will inherit even if the nominee is father in law?thnx

Dear Client,
At first both of you must live a happy life, rather than thinking about your matters that take place after death.
Nobody can predict who will die first or last, over and above your father in law is having more age than both of you.
One thing you must bear in mind is that, in the case of bank accounts, you must change to "either or survivor", mode of operation. Otherwise you will face difficulty in operating the bank accounts after your husbands death and vice versa.
If you make a will, the nominee of the bank account has to carryon the wishes of your will.By making mere nominee that nominee can not take everything, if there is any remanants after your will he can take that.
Do not think about death, live a life of happiness. You can certainly adopt a child if both wish and can give a life to a kid.
Finally the property will devolve into your husbands family.

Nominee will get the benefits
But at the same time you can remove him from being your nominee and also can start own savings with anybody els as nominee

Soon after your death your legal nominee claim your savings

If one christian died his widow will get 1/3 And widower will also get the same rest will go equallya to their legal heirs and by virtue of marriage the domicile of women will change as that of her husband so only his family members will inherit
