Questions Answered by Advocate Sachindas P

Q: How to refund money from a coaching center if no classes attended

I have paid ₹ 5000/- to a Coaching Centre and No classes were attended. I asked for refund ande they are ignoring it. Is there any chance to get a refund ?

Advocate Sachindas P answered
Dear Client,In this matter you had failed to comply the duty as a student to attend the class, as per the stipulation of the coaching center, to which you had expressly agreed by paying the fee to attend the class.Hence the is no deficiency on the part of the coaching center. So there is no possibility or liability to refund the fee you had filed.Anyway you can file an experimental complaint before the CDRF of your District, but there is always a risk of fine for filing malicious complaints and dragging the people to court. So be careful while filing this complaint before CDRF.

Q: What is the validity of a foreign judgement in India

I have obtained divorce in Kuwait where my spouse filed the divorce petition and I did not want to contest and did not make an appeal. We were married in India in a Church and we are both currently working in Kuwait. Is the divorce judgement valid in Kerala.

Advocate Sachindas P answered
Dear Client,I think it will be better to obtain a divorce via joint petition, that will be better for both of you. There will be several hurdles in changing the marital status in your passport to "Divorcee", you may cfurnish a copy of the judgement from the Hon'ble Court of Kuwait and file a request before the Indian Consulate in Kuwait, if the marital status is corrected to "Divorcee" then it is ok. So just do this and if the Indian Consulate had not corrected as per the judgement of the Hon'ble Court of Kuwait, you have to obtain divorce as per the community guidelines from a competent Court having jurisdiction to grant you divorce

Q: Can husband be granted visitation rights if he is an alcoholic

I am a Christian and its a matrimonial question. I am currently undergoing divorce , 2 hearings are over , but my husband has recently filed a petition to see my daughter (5yr). He is a thorough alcohol addict and it is not possible to stay with him . Cannot allow my daughter to be with him for even a minute. His petition is to keep my daughter with him in his house for a month during his vacation. First hearing of this case is over and the court wishes to review the case and has kept a second hearing on the coming 9/4/2018. In case the judgement goes in his favour then will my baby be immediately sent to him? because in the event this should take place , I wish to appeal to the high court .I am currently working in Dubai and my mother in India is representing me as I have given her the power of attorney . The case is being fought in kerala and my husband is in kerala too and I have trust in my lawyer but would like a second opinion.

Advocate Sachindas P answered
Dear Client,Be cool. The court won't send the child with your husband. You mother is supposed to bring the child if the court orders for interaction, which will last only for 2 hours, if your mother did not comply with the order problems will arise. Leave rest of the matters to your advocate.Be cool and leave the rest pf the matters to your advocate. Since it is a public forum, I have limitations in detailing the point.
