Whether Stridhan and maintenance be granted after divorce

Hi i was 7th months pregrant i had come to pune delivery ..i deliverd baby girl but husband in laws never came to see me.husband illegally started staying with other girl. I filed domestic violece case after a year then he filed divorce nothing till now its been years now. Not even single order. Will i get my stree dhan back.will my daughter get her rights.i dont want divorce but he want divorce.

In this case you have to proceed to the family court for the restitution petition
Your streedhan will be given to you after making an application made to the family court
You can seek relief in respect of rights of your daughter from court as well

Yes very much you will get the rights for your daughter and you as well the husband is liable to pay maintenance the advocate should file an application for maintenance in the family court for the same and ask to maintenance for the daughter

As you have mentioned that you have already filed for domestic violence then ideally atleast your interim maintenance order should have been passed by now. You can also ask for maintenance under Hindu Adoption and Maintenance Act.
