Whether breaking an engagement amounts to defamation

After breaking engagement, girls side started making false allegation on my family and so I written a mail to only girl's brother explaining why I am breaking engagement. I wrote : ---- " Decision of not marrying is because of characterless attitudes of your family members especially your sister. " --- I wrote above line as they are making false allegations on me and my family . And now they are saying --I will go to court case for MAANHANI. What should I do now and what they can do for this ?

You need not do anything till they send any legal notice to you or file any complaint or case in the court. So far as chances of filing any case against you are concerned, it is very unlikely that they would file any case against you considering the legal hassles, wastage of time and expenses involved in a case.

Even if they choose to file any such case, you would have ample opportunity to defend yourself. Your statement which they say are defamatory has to be considered in the over all facts and circumstances and what you intended to convey to them. There is no need to worry; but be cautious and do communicate to them in future without legal advice.

She can file a case for defamation because you used a word "characterless" for her family and the girl. But the case will not stand because the communication takes place between you and her brother. You have not defame her in the society. Hence the case for defamation will not be made out against you. Revert me. All the best.

Have you got any evidence of her character lessness or you have told with out any reason. Please discuss in detail so as to get you proper reply. Moreover you have to file your defense only after they file a case on you. For that you have to wait & watch
