What to do when brother trying to sell parents property illegally?
05-Oct-2023 (In Family Law)
We are three sisters and one brother. We lived in Nagpur and my parents bought lands in Nagpur. After getting married we three sisters went our respective husband's house in Hyderabad. My parents passed away few years ago. My brother is trying to sell the land with out our notice and is refusing to give any share to sisters. What can we do.
Dear Client,
Raise the objection before local Talathi office and registration office. You can send legal notice to that authorities informing that all legal heirs have right in said pty and no agreement be registered without your consent. Also give paper publications to avoid any raud sale by your brother.

You can file a civil suit and take out notice of motion in the district court to get an permanent injunction to stop your brother from selling the property. If it is an ancestral property and your mother and father both has died without any will you, you are the legal owner as per the hindu succession act and have equal rights in the property

If your father passed away after 2005 then you have equal share in property.
Now you can claim your share by sending notice to your brother and therafter by filing suit.In the said suit your can pray for stay order against brother for not selling property.
