What to do my husband harasses me

22-Jun-2023 (In Family Law)
Hindu.Married in 2013. No kids. Husband is having extra marital relationship. I have been driven out of his house by his parents and husband. Living with my parents since Dec 2017. Husband has cut off all contacts and mentally torturing. Am detected with acute level of depression and being treated. Have recently found out that husband has formed a company with this lady he is involved with and my father in law is the proprietor. My husband and this lady both work in Cognizant Technology Solutions. Is there any way I can take legal action against the company? Can husband open company without wife's consent? Does cutting off all contacts for 6mnths and roaming about with other lady amount to mental cruelty? I do not want to give him mutial divorce. What steps can be taken? I have proof of my husband's Cognizant job but do not have any pay slip. How to prove his income in court for maintenance?

File 498 as action against torture upon you as well as domestic violence and to get hold of his pay slip you can get through RTI. yes he cannot run business if he is working in a job. Do these immediately

Any major can befriend with anyone as a matter of his/her fundamental right. In your case you cannot held liable to the lady or even the Company as it will amount to foolishness. At this point of time you need to hold your breathe and take the legal recourse to tackle your situation. Under DV Act you can have right to residence over your husband's property and to seek maintenance.
Also please note that you can mention any figure of your assumption, it is your husband who should contest that figure, be it lesser or more. Apart please file a private complaint or police complaint with the help of an Advocate at the earliest. I don't understand how this important issue is pending since 2013!!

You have a very good case against your husband for mental cruelty and if you don't want to give mutual divorce, you can always claim your rights in respect of your matrimonial home and also for your maintenance.
