What to Do If Husband Sent a Notice Under Section 9 of Hindu Marriage Act?

04-Jul-2024 (In Family Law)
My sister has been married for 14 years and has two sons. Two years ago, her elder son was sent to a hostel against her wishes, and her younger son, who is mentally challenged, lives with her.

In June last year, her husband and in-laws forcibly evicted her and her younger son from their home. Now, her husband has sent a legal notice under Section 9 of the Hindu Marriage Act for Restitution of Conjugal Rights (RCR). Since we do not have a father or brothers to support us, what legal options are available to protect her rights and ensure her well-being?

She should immediately (a) oppose the Section 9 HMA restitution petition by filing a written statement and raise factual/legal defences (she was turned out/has reasonable excuse, cruelty/desertion, collusion, etc.); note the Supreme Court's approach to Section 9 in Smt. Saroj Rani v. Sudarshan Kumar Chadha (AIR 1984 SC 1562). [https://indiankanoon.org/doc/1382895/] (b) concurrently file an application under the Protection of Women from Domestic Violence Act, 2005 for protection orders, a residence order and monetary/medical relief (Sections 12/19/20) -courts have repeatedly enforced the right to reside in the shared household (see Sneha Ahuja/Satish Chander Ahuja decisions). [https://indiankanoon.org/doc/542601/] [https://indiankanoon.org/doc/166739200/] (c) apply for interim and permanent maintenance before the Magistrate under BNSS (order for maintenance, Section 144, replacement of old s.125 CrPC) to secure immediate financial support. [https://lawfyi.io/the-bharatiya-nagarik-suraksha-sanhita-2023-bnss-bare-act/] (d) if there is assault, dowry-demand or cruelty, lodge a criminal complaint/FIR under the Bharatiya Nyaya Sanhita (offences against women -e.g. cruelty/dowry provisions, Sections 85'86) and seek police protection and urgent relief. [https://constitutionofindia.in/chapter-5-of-offences-against-woman-and-children-bns-2023/] (e) seek urgent ex parte residence/maintenance/protection orders, preserve evidence (messages, medical reports, witness names), and consult a family/criminal lawyer or legal aid immediately to press these remedies together.

Understanding Section 9 of the Hindu Marriage Act – Restitution of Conjugal Rights

Section 9 of the Hindu Marriage Act allows a spouse to file a Restitution of Conjugal Rights (RCR) petition, requesting their partner to return to the matrimonial home. If your husband has sent an RCR notice, it means he wants you to resume the marriage.

Your Choice Matters
You are not legally obligated to return. If you do not wish to continue the marriage, you can consider filing for divorce. However, if there is no valid reason for separation, the court may favor the RCR petition, and your husband could use it as a legal ground in the future.

Legal Remedies Available
If you are facing mental or physical cruelty, you can:
  • File a police complaint against your husband.
  • Seek protection under the Domestic Violence Act, which provides:
    • Compensation for harassment
    • Interim maintenance for financial support
    • Right to live separately at your husband's expense
Consult a Family Lawyer
Every case is different, and legal steps depend on the situation. Consulting an experienced family lawyer will help you understand your rights and the best legal options for your situation.

How to Respond to a Section 9 Notice If You Don’t Want to Live With Your Husband
  • If you do not wish to live with your husband, you should file a reply clearly stating the reasons for your decision. You can also appear before the judge and give your consent if you choose to reconcile.
  • However, if you refuse to return, your husband may use this as a ground for divorce after one year of the Section 9 order.
  • To protect your financial rights, it is advisable to file a maintenance application under Section 125 CrPC, which can help you receive financial support from your husband.

Section 9 of the Hindu Marriage Act grants spouses the right to cohabitation and marital relations. It allows a spouse to legally request their partner to return to the matrimonial home.

In such cases, the judge calls both parties to explore the possibility of settlement. However, reconciliation is not mandatory—it depends entirely on whether both partners are willing to resolve their differences.
  • If you do not wish to reconcile, attend the court proceedings, file a reply stating there is no possibility of resolution, and wait for the judgment.
  • This is a legal process, so there is no need to worry. You can simply inform the court that reconciliation is not possible, and the case will move forward accordingly.
