What to do husband and his parents physically and mentally abused me
26-Jun-2023 (In Family Law)
My husband and His parents physically and mentally abused me and beat me up as they were forcing me to quit my job. I left the house with my 4 year old daughter and came back to my parents hoise. Now after 2 months he have sent me a advocate notice stating that he have taken a new rented accomodation and want me to come and stay there. Now when i did research about the rented accomodation i found out that it is situated at a very secluded and isolated place. Even to catch a auto or bus i have to atleast walk for 3 Kms . He is doing all these so that i am forced to leave my job. I am very much concerned about my safety at that place. I even asked that i am ready to return at my matrimonial house , but he refused saying that i have no rights on it. The house is registered on his father name. What should i do?
See first of all in India everybody have right to say anything be it your husband or anyone. Please ask him that better to concentrate on his work and let the trouble of interpreting laws be taken by the Judiciary system alone, at least till India is a democratic State or he does become the president of India!
Please consult an Advocate immediately in this regard and send him a counter legal notice making him aware of all the laws quoting sections even on the right to residence over husband's property under DV Act and ask him that the rented property has to be decided by both of you and not just him alone because he cannot force to stay wherever without your consent.
Even if the matrimonial house is in your father in laws name, you have every right over it, there are judgements on it. Moreso, please emphasise on going to matrimonial home because they may allegate you of removing son from aged parents which will be valid grounds for divorce, moreso file domestic violence thereafter.
