We want to marry legally but girls family is not allowing her

24-Jan-2023 (In Family Law)

Sir, me and My Girlfriend want to get married with the permission of our respective families. My family has agreed with this but the girls family is against this and kept her under house arrest without any communication medium. What legal step should i take to communicate with her and marry her?

You can with help of common friends get her out of the house and marry at registrar of marriages office. If both are adult and of sound mind and consent to marry legally no one can stop both of you from marrying.

Dear Sir,
We presume that you and your girlfriend have completed 21 years and 18 years of age respectively to get legally married.
If you are sure that, your girl friend wants to marry you even against the wishes of her parents, then you can take help of police authorities to end her house arrest. Now a days, there are special cells in the office of the police commissioner to help women in distress.
If the police authorities do not co-operate, you can file a petition in the High Court of competent jurisdiction for appropriate orders/directions. You can also take help of some organisation working in the field of women empowerment for ending house arrest of your girlfriend.
As regards permission of parents, they can not be forced to give consent to your marriage. However, you may take help of common friends/professional mediators to pursuade her parents to agree to your marriage.

age of girl is not disclosed. you may file complaint application before local police and also issue a legal notice to her parents. still if it fails, you may file an application before the local court for production of that girl. hopefully, this will solve your problem but if the girl is minor then nothing can be done.
