Dear client, file a case of legal separation under Hindu marriage act, apart from that you can claim maintenance only if your are not earning or your earning is less as compare to your spouse, further you have a right to claim residency.. you should have grounds to file the above cases..

You can file a petition for judicial separation in the family court under section 10 of Hindu Marriage Act 1955. after obtaining decree of judicial separation you will able to live seperate from spouse. However, after'period of one year any party'can file divorce as it is a valid ground of divorce.

dear questioner,there are various grounds of divorce and judicial separation in law...like mental disorder,leprosy or venereal disease, conversion to some other religion is also ground of divorce and separation. you have to select a ground for separation.
procedure is just like other divorce matters. but you have to confirm the ground on which you want to get separated.i mean you have to establish one of the said grounds in a court of law.only then you can get a decree of judicial separation.for more information you can further contact me in detail.
