Want to leave husband house without any legal rush please suggest

My marriage is 7 years old and i have a child. My husband age is 38 now and i am 25. Now its getting hard to survive with him. I want to leave his house also i don't want to go my parents house. Just want to lve with my son only . plz suggest me rush free solution . i am from up while my husband belong to haryana.

there are 2 ways to getting divorced, contested and mutual. with contested divorce petition you also can file u/s 125 crpc for maintenance, and domestic violence case. This cases will run according to court proceedings with proper documentations. incase of mutual it should be with mutual understanding, both the parties should agree in certain terms and conditions otherwise mutual cannot be processed.

it all depends on whether or not your husband is also willing to go for divorce. if your husband does not want to go for a divorce, then you will have to file a one sided petition which takes time to be decided. if your husband is willing for the divorce, then it will be a quicker remedy.

I have perused your query and would advise you to go for a divorce by way of mutual consent under section 13 B of the Hindu Marriage Act. It is a faster method. However, per contra your husband is not ready to give you divorce by way of mutual consent than a divorce petition has to be filed by you and contest, which will take a longer time.
