Unregistered Family Settlement Deed But Notarized

1) Family settlement deed is notarized in 1995, can we pay stamp duty now? 2) Is it mandatory to register a family settlement deed? if not mandatory then case laws? 3) unregistered Family settlement deed will be inadmissible in evidence? 4) After executing notarized family settlement deed, can owner again make a will to some other relative? 5) can we file a declaratory suit on unregistered Family settlement deed?

You can go to treasure office and apply to collector that you want to deposit appropriate stamp on the same family settlement deed and can legalize the same or can file declaration suit again the court will order the same.

2016(8) SCC 705 says that even without registration a written document of family settlement can be used as corroborative evidence as explaining the arrangement made thereunder and conduct of parties.

you may adjudicate the document and pay proper stamp duty.
