Undertaking agreement by spouse

My spouse doesnt respect me and quarrels with and my parents very often. We have a kid. My spouse threatens me with suicide. I dont want to divorce because of my child. Now she is staying in her parents home. I want a legally binding undertaking before I take her back that she wont harass, threaten ,quarrel and respect me and my parents. Is that possible, If yes what kind if legally binding agreement be made. So that I am safe from harassment and her threats in future.

There is no scope for agreement rules under the Hindu Law that Hindu Marriage is not a contract. Therefore such kind of agreement may not legally stand.

Here you can file a complaint against her for mental harassment and with the assistance of Police officer you can take written under taking from her not to interferer in your parents life.

Apart from this you can take legal separation from your spouse. It does not amount divorce. The marriage bond between you and her will continue in the same way. Here also you can take protection by way of restraining her from entering into your personal life.

Dear Sir,
Any bond is not valid between the couple. Just for your satisfaction take her to police station and get a stamp paper for Rs.200/- and write all the conditions and get it signed by her and her parents about her suicide threats etc. The police have to influenced by some local politicians. Or get issue a legal notice and get her signature before a notary.
