Summon for Maintenance and Welfare of Parents and Senior Citizen Act

I have received a summon by Tribunal of maintenance of parents and senior citizen case presided by ADM South Delhi Revenue Dept. what can I expect to happen? The applicant is my mother who lives in Delhi and I live outside the state. I don't have the details of the application since I received only the summon. What should be my next course of action?

You should not ignore the summons. Since your mother is residing in Delhi, the Maintenance Tribunal in Delhi can entertain the case even though you are residing outside Delhi. Normally, along with the summons, you should also receive a copy of the application and its documents. Since you have received only the summons, on the first date you should appear before the Tribunal and request a complete copy of the petition/application and annexures and reasonable time to file your written reply.

Consider the basic details like Who is the owner of the property? Is there an ongoing family dispute ? Is there anyone who may have tutored your mother? After this appear before ADM and give a detailed response

the immediate course of action is: obtain the complete petition and annexures, verify the next date, appear on the date fixed, seek reasonable time to file your response, and then contest the application on the facts and financial circumstances. If an adverse final order is passed, the Act provides an appellate remedy before the Appellate Tribunal.

in compliance of the summons you would have to appear before the adjudicating authority that has issued the summons to you. in case you do not wish to appear you may have a advocate appear on your behalf and do the necessary formalities and conduct proceedings there after
