07-Sep-2023 (In Family Law)
Step dad has been abusing my mother and we need protection against him. But my mom is not likely to have a divorce with him because my sister is 14 years old the divorce may affect her future. Is there a way we can put him away and still have peace in our family?

Hai, I think its the same query am repeating. so u just need to be away from him n be secure. A protection order from magistrate court will do the thing. Either u apply directly before protection officer in ur taluk or consult a lawyer f ur jurisdiction to file application under domestic violence. Google domestic violence act n check out sections 18 n 19. U will get an idea then... read through it n then u can realise wat orders u r entitled. Get the help f a lawyer n consult before starting. hope am upto ur query

The primary aim of the Protection of Women from Domestic Violence Act, 2005 is to provide protection to the wife or female live-in partner from domestic violence at the hands of the husband or male live-in partner or his relatives. So your mother can file petition under Protection of Women from Domestic Violence Act, 2005 before judicial first class magistrate .The DV Act provides that the aggrieved person may approach not only the Magistrate but also the Civil court, Family court or any other courts and seek relief’s including protection orders, residence orders, monetary reliefs, custody orders, and/or compensation orders. The D.V. Act has been enacted to provide a remedy in Civil Law for protection of women from being victims of domestic violence and to prevent occurrence of domestic violence in the society.
