Staying away from my husband since 5months

31-Mar-2023 (In Family Law)
Hi, I am staying away from my husband since 5 months. My father in law is not allowing me to stay with my husband, my husband is his puppet. They keep avoiding to take me home for random reason. Even if I want to go, they are not allowing. I dont have any proof for this. Will they be able to claim a divorce with this reason (me staying away from my husband). I also want to know if there are any law which they are trying to apply.

if they file a case then before that they will send legal notice for divorce. If a couple must stay apart, it shouldn't be for more than six months or maximum one year. During this period, conscious and sustained efforts must be made to manage the issues which distance breeds like loneliness, non-frequent sex, lack of emotional and physical support After six months the parties have to present themselves again in the court for making a second motion confirming the mutual consent filed earlier. It is only after this second motion that a decree of the divorce is granted by the court
