Second complaint maintaintable for fir
08-Aug-2023 (In Family Law)
Hi,my wife lodge a complaint 406,498a & dv act against me & my family. Actually her first complaint made a compromise but she didn’t come, and after 15days she lodge again a complaint(diffrent allegation) and police made compromise 8lac on this complaint, but due to one yr sepration limitation MCD didn’t file. So she lodge again compaint and police made a FIR on her 3rd complaint, but girl 1st,2nd & dv act complaint are diffrent allegation and totally changed. And police doesn’t show her 1st complaint in Chargesheet and FIR lodge on her 2nd complaint. So i want to know if i show 1st complaint infront of judge then will judge discharge fir or not. In india law Fir can maintainable on 2nd complaint with diffrent allegation. Plz reply
Dear Client,
there is no law or rule which can stop you from making complaints.
now question is whether judge can quash FIR or not. so yes for quashing FIR you need to file writ petition in high court.
secondly you can show all old complaint and compromise in evidence to court where police file chargesheet. that will help you in acquittal
