Rights of Granddaughter in the property of grandfather already divided
29-Jun-2023 (In Family Law)
Hello, My grandfather passed away intestate. His self-earned property was partitioned by a court decree between my uncle and my mother equally. Now, my uncle, through a gift deed, gave his entire share of 50% to his son. My uncle’s daughter however wants a share. She has filed a lawsuit. Query: Does my uncle’s daughter have a right to a share in my uncle's 50%?
Partition has effected to your uncle and your uncle has received his part of share and next questions are that u r uncle share would be divided into the family his daughter has share in it and she will succeed in her father estate.
Sons and daughters have several rights as a coparcener. For instance, they get a right in ancestral property by birth; right to survivorship: if one coparcener dies the property gets divided among the rest. They are in joint possession and ownership of property and if they want partition, they can claim so by filing a partition suit...
