Right to live in husband’s property

Hi. I have a 6 months old daughter. My husband has some screenshots of romantic chats with one of my close friend and caught us in a group outstation outing. nMe and my daughter left house temporarily. Currently we don’t have a place to live. Can I go back to my husband’s house and live as he hasn’t filed divorce yet and same here. I’m afraid if he can evict us legally? The house belongs to my husband only and what if if he transfers it to his mother? Can she evict us?

In this case mam you can go to your husbands house and live there and he Can't remove you illegally because there is a duty of a husband to maintain his wife and children . if he evict you legally buy legal process then he had to arrange some another accommodation for you

You have got right to residence in your matrimonial home. No one can say NO to come and stay at your matrimonial home. And as far as your daughter is concerned she is having heritable rights over the property whether it belongs to your husband or your mother-in-law. For more legal assistance I am just a call away.

if you are not legally divorced then you have the same right as a wife and you can stay with your husband perpetually. however if the property is transferred to his mother , then she has the right for your eviction although she needs to give a ground for that. in case the divorce case is not there then you cannot be evicted just by yourself. the eviction will be of the husband also. in that case the husband might take a place on rent and you will have to be in that rented property

Hello Madam,
as long as you are not legally separated, you still remain his wife and yes can go back to the house.
on legal front, rarely court will order you to move out of house

You must file sec 9 case to take u from ur parental home for conjugual rights court willl give u a chance to reconcil your case if everything goes well u can go matrimonial from court order for further query plz free to call me
